These Terms and Conditions (“Terms”) govern your use of the services provided by Sightseeing Edinburgh (operated by Sightseeing Company) and any bookings or purchases made through our platform. By accessing, browsing, or making a booking with us, you agree to be bound by these Terms.

2. Role of Sightseeing Edinburgh

Reseller & Agent: Sightseeing Edinburgh acts as an online travel agent (OTA). We resell tours and experiences operated by third-party suppliers (“Suppliers”). In such cases, Sightseeing Edinburgh acts as an agent on behalf of the Supplier. The contract for the provision of the travel service is between you and the Supplier.

Affiliate Links (Temporary):
In some cases, our platform redirects you to other online travel agencies (“OTAs”) or Supplier websites via affiliate links. These affiliate links are temporary and are only in place until our direct system integration is built, allowing us to host a wider range of products directly on our website.
When you make a booking via such links, your contract is directly with the third-party OTA or Supplier, not with Sightseeing Edinburgh.

Support: While Sightseeing Edinburgh is not a party to bookings made via third-party platforms, we aim to provide customer support and guidance where possible to assist you in resolving issues with the Supplier or OTA.

No Liability for Third Parties: We are not responsible for:

• the accuracy of third-party platforms,
• the fulfilment or quality of services purchased from third parties, or
• any disputes arising from bookings made with third parties.

3. Your Responsibilities

• Ensure that all information provided during booking is accurate.
• Comply with any terms and conditions imposed by the relevant Supplier or OTA.
• Familiarise yourself with the cancellation, refund, and amendment policies of the Supplier or OTA you book with.

4. Complaints & Issues

Bookings Made Directly with Sightseeing Edinburgh:
If your booking was processed and payment was taken directly through Sightseeing Edinburgh, please contact us first regarding any complaints, service issues, amendments, or refund requests. We will liaise with the relevant Supplier on your behalf where appropriate.

Bookings Made via Affiliate Links or Third-Party OTAs:
If your booking was completed on a third-party Supplier’s platform or another OTA’s platform, you must raise any complaints, service issues, amendments, or refund requests directly with that Supplier or OTA, as they are the contracting party.

Support & Advice:
Even if your booking was completed via a Supplier or OTA platform, you may still contact us for guidance and support. While we cannot process refunds or enforce resolutions for bookings not made directly with Sightseeing Edinburgh, we will do our best to provide advice and point you in the right direction.

5. Pricing & Availability

We make every effort to ensure the accuracy of prices, availability, and descriptions displayed by Sightseeing Edinburgh. However, this information may be provided directly by Suppliers and is subject to change without notice. Sightseeing Edinburgh accepts no liability for errors, omissions, or changes beyond our control.

6. Payment Security

Where payments are processed directly through Sightseeing Edinburgh, transactions are handled securely through trusted third-party payment providers. We do not store or have access to your full payment card details. Responsibility for fraud prevention, payment authorisation, and chargebacks lies with the payment provider.

7. Limitation of Liability

To the maximum extent permitted by English law:

• Sightseeing Edinburgh shall not be liable for any loss, damage, injury, delay, or expense arising from the acts, omissions, or negligence of any Supplier or third party.
• We make no warranty as to the accuracy or completeness of information provided by Suppliers or displayed on linked platforms.
• Our liability is limited to the amount you paid us (if any) for a booking made directly through Sightseeing Edinburgh.

8. Intellectual Property

All content provided by Sightseeing Edinburgh, including text, images, branding, and logos, is owned or licensed by Sightseeing Company. You may not copy, reproduce, or distribute content without our prior written consent.

9. Force Majeure

Neither Sightseeing Edinburgh nor any Supplier shall be liable for failure or delay in performance of their obligations where such failure results from events beyond reasonable control, including but not limited to natural disasters, severe weather, strikes, industrial disputes, war, terrorism, civil unrest, or government restrictions.

10. User Conduct

You agree not to use Sightseeing Edinburgh for any unlawful purpose or in a way that may harm, disrupt, or impair the functionality of the platform or the experience of other users.

11. Third-Party Links

Sightseeing Edinburgh may contain links to third-party platforms or services that we do not control. We are not responsible for the content, terms, or privacy practices of those platforms.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sightseeing Edinburgh regarding your use of our services and supersede all prior communications or representations.

We may update these Terms from time to time. Any changes will be posted with an updated “Last Updated” date. Continued use of Sightseeing Edinburgh indicates your acceptance of the updated Terms.
